In this COVID-19 situation Wastage of Single Dose of Vaccine is Criminal Crime- Delhi High Court

Court also asked the Central government to update its vaccine registration app to accommodate those under the category of 18-45 years

The Delhi High Court on Tuesday expressed its concern over the wastage of the COVID-19 vaccine and said that the wastage of the vaccine is Criminal Waste.

Vaccine wastage, which is life-saving, is a criminal waste. We instruct the government to look into the situation to allow full use of the vaccine, ”the High Court said while hearing a petition related to the COVID-19 status in the national capital.

  • Delhi government counsel Rahul Mehra told the court that one company, Inox, has stopped supplying oxygen to Delhi and sent it to another state.
  • The court has asked the owner/managing director of INOX to be present on the next date of hearing of the petition.
  • The High Court said that it is clear that the health-related infrastructure is in a phase of imminent collapse.
  • They also concern over the number of COVID-19 patients in the national capital on daily basis had exceeded 25000.

What Delhi High Court said?

  • Once the vial is opened, it has to be either fully consumed, or the remainder goes waste”, observed a division bench comprising Justices Vipin Sanghi.
  • The High Court while replying to the report wasting 44 lakh vaccine doses out of 10 crores said, “Now we are losing youth, why is there wastage of even one dose?
  • The court also asked the Central government to update its vaccine registration app to accommodate those under the category of 18-45 years.
  • This update will ensure that all doses are fully used. Such flexibility is available in other countries such as the USA, ”the High Court stated.
  • For this purpose, the Government should modify their mobile COVIN application appropriately, urgently.

Delhi High Court Suggestion to Center

  • The Center or the Drug Controller should not hesitate to invoke its power under the Patent Act as people’s lives are being lost at a very fast pace and must take people’s lives ‘priority’ over everything else.
  • The bench also suggested the center take up the matter with the supplier on the issue relating to the short supply of life-saving drugs.
  • It has also directed the central government to negotiate with manufacturers, patent holders, and licensees, who are said to be enhancing the capacity of allegedly useful drugs such as ivermectin, dexamethasone, and prednisolone.
